RECOGNITION

Xarelto is a blood-thinning medication approved by the U.S. Food and Drug Administration in 2011 to prevent blood clots in patients who suffer from atrial fibrillation, deep vein thrombosis, pulmonary embolism and stroke. It also is often prescribed for patients after undergoing knee or hip replacement surgery.

Although advertised as a more convenient alternative to warfarin (brand name Coumadin), there have been many reports of serious and life-threatening Xarelto side effects, including:

  • Internal hemorrhaging
  • Uncontrolled bleeding
  • Gastrointestinal bleeding
  • Pulmonary embolism
  • Heart attack
  • Stroke

There is no known antidote to Xarelto, which means that if a patient on this medication is injured and starts bleeding, doctors may not be able to stop the bleeding before the patients suffers further injuries or death.

Throughout the United States, individuals who have suffered these severe side effects are filing lawsuits against the drug’s manufacturer alleging the company knew the risks and failed to inform the U.S. government, medical professionals and patients of potentially life-threatening issues.

Who Makes Xarelto?

German-based pharmaceutical company Bayer A.G. developed Xarelto. The company is best known for such medical contributions as aspirin, developed in the late 19th century; phenobarbital, a sedative commonly used for epilepsy in the 1970s; and heroin, which was originally developed as a substitute for morphine.

Janssen Pharmaceuticals, a division of Johnson & Johnson, along with Bayer handled the marketing of Xarelto. Lawyers who are filing Xarelto lawsuits know that this is not the first time either company has been scrutinized for improper practices.

Janssen is currently under investigation by the United States Department of Justice because of allegations that the company paid bribes to pharmacists and wrongfully marketed Risperdal for “off-label” uses.

Bayer came under fire in 2011, receiving an FDA warning that said the company overstated the benefits of its contraceptive drug Yaz. It was later ordered to add a warning to the drug’s label because of an increased risk of blood clots.

Why have Xarelto lawsuits been filed?

Since its approval in 2011, the FDA has received more than 2,100 reports of adverse events related to use of Xarelto, known generically as rivaroxaban. In 891 cases, hospitalization was necessary, and at least 183 patients lost their lives.

Xarelto lawyers have filed claims against the drug’s manufacturer and marketers, Janssen Pharmaceuticals and Bayer Healthcare. The lawsuits allege the following:

  • Janssen Pharmaceuticals knew of potential uncontrolled, irreversible bleeding and failed to warn patients and doctors of the risks.
  • Bayer and Janssen advertised Xarelto as a superior medication to other blood thinners despite knowing the bleeding risks and that the effects could not be reversed as easily as with other anticoagulant medication.
  • If Janssen and Bayer had properly informed patients and physicians of the risks, both patients and doctors would have chosen alternative blood thinning medication warfarin, with which uncontrolled bleeding can be treated.
  • The companies failed to update product warnings in a timely fashion.

The FDA issued a warning letter in 2013 concerning Xarelto. The federal agency said a print advertisement in WebMD magazine minimized the drug’s risks and made misleading claims. However, there have not yet been any recalls issued for this potentially dangerous medication.

What to do if you are taking Xarelto?

If your doctor has prescribed Xarelto, it’s important that you avoid activities that could lead to cuts, bruises, external or internal bleeding. If you suffer an injury or begin to experience symptoms such as dizziness, weakness, confusion, severe headaches, vision changes, or persistent bleeding, you should contact your doctor immediately.

Xarelto patients should also inform all of their doctors — including dentists — that they are using this medication. This is very important for every Xarelto user, but particularly if you have medical or dental procedures scheduled, suffer from uncontrolled high blood pressure, take aspirin, abuse alcohol, or have abnormal kidney function, and for women who are or become pregnant.

Do I need a Xarelto lawyer?

While litigation on this scale can take years to resolve, that doesn’t mean sufferers of Xarelto side effects can wait years to file a claim.

Every state has its own statute of limitations, which is a time limit a person has in which to file an injury claim. If you haven’t filed a claim within this time limit, then you will not be able to bring legal action against the people and organizations responsible for your injuries and monetary losses. If you’ve suffered serious complications of a drug, it’s in your best interest to look into your legal options right away.
